These terms apply to the use of stairspro.ca and to every quotation, order and contract for goods and services supplied by STAIRS PRO, operating as Stairs Pro Canada. Please read them before placing an order. By accepting a quotation or paying a deposit, you agree to the terms set out below.
We manufacture to order. Nothing we build is a stock item, and that shapes most of what follows.
1. Who you are contracting with
- Supplier
- STAIRS PRO (Stairs Pro Canada)
In these terms, “we”, “us” and “our” mean STAIRS PRO. “You” means the person or company placing the order.
2. Using this website
This website is provided for information. Dimensions, specifications, finishes and lead times shown here are indicative and form part of a contract only when they appear in a written quotation we have issued to you.
All photographs, drawings, renderings, text, logos and design content on this site belong to STAIRS PRO or are used with permission. You may not copy, republish or use them commercially without our written consent.
We may change, suspend or withdraw any part of the site at any time.
3. Quotations
- Quotations are issued in writing and are valid for seven business days unless we state otherwise.
- A quotation is based on the drawings, dimensions and site information you supply. If any of it changes, the price may change.
- Prices are quoted in Canadian dollars unless stated otherwise, and exclude applicable taxes unless the quotation says they are included.
- A quotation is not an order. A contract is formed when you accept in writing and we receive the deposit.
- Obvious errors in pricing or specification may be corrected before work begins.
4. Measurements and drawings
Because every staircase is made to order, accurate dimensions matter more than anything else in the process.
- Every staircase is manufactured to the live dimensions of your site as they stand at the time of measuring, and to the figures shown on the approved drawing.
- Deductions for finishing materials must be confirmed by you in writing. This includes hardwood and other flooring, underlay, drywall, plaster, tile and any other finish that will be applied after our measurements are taken. We build to the deductions you confirm.
- Where you supply the measurements, you are responsible for their accuracy.
- Where we take a site measure, we are responsible for those figures, provided the site is at the stage we agreed for measuring.
- We issue shop drawings and renderings for your approval before manufacture. Nothing is cut until you approve them in writing.
- If any site dimension changes after you have confirmed the drawings, and the staircase does not fit on arrival as a result, any alteration, remake or replacement is at your expense, along with any additional delivery and installation cost.
- Once approved drawings are signed off, changes may incur additional cost and delay, and may not be possible at all if material has been cut.
5. Payment
We work on progress-based payment terms. Unless your quotation states otherwise:
- 30% on order — this reserves the cost of your materials and starts our architectural drawings.
- 50% on approval of drawings — this releases your order into production.
- The balance is discussed and agreed with you, and set out in your quotation.
- Each stage of work begins only once the payment for that stage has been received.
- Title in the goods remains with us until payment is received in full. Risk passes to you on delivery.
- Late payment may attract interest and may suspend further work, delivery or installation.
- Trade and dealer accounts are subject to separately agreed terms.
6. Lead times and delays
Lead times quoted on this website and in our documents are estimates based on normal conditions. We work hard to meet them and will tell you promptly if a date moves.
We are not liable for delays caused by matters outside our reasonable control, including late approval of drawings, changes you request, site not being ready, material or supply shortages, carrier delays, labour disruption, severe weather, fire, utility failure, or any act of government.
7. Cancellation and changes
Our products are custom made to your specifications and cannot be resold. This means:
- There are no cancellations or refunds once the order is confirmed and the deposit has been received. At that point materials are reserved and drawing work begins.
- The original design deposit is non-refundable in all cases.
- Change requests after approval are quoted separately, are payable in addition to the contract price, and may affect the delivery date.
- Change requests may not be possible at all once material has been cut.
Because these are custom-made goods, statutory cooling-off or return rights that apply to stock consumer products do not generally apply. Your rights under applicable consumer protection legislation are not affected.
8. Delivery
- Delivery is to the address stated in the order. You must ensure safe and lawful access for the vehicle and the goods.
- Someone must be present to receive the delivery and inspect it. Damage or shortage must be noted at the time and reported to us in writing within 48 hours.
- Where we ship outside our installation area, goods travel by freight carrier. Any duties, taxes or brokerage charges outside Canada are your responsibility unless the quotation says otherwise.
- Failed or refused deliveries, or deliveries that cannot proceed because the site is not ready, may incur redelivery and storage charges.
9. Installation
Where installation is included in your order:
- The site must be ready, clear, dry, safe and accessible on the agreed date, with the structure complete to the point specified in the drawings.
- Power, lighting and reasonable working space must be available to our installers.
- We are responsible for the staircase, railing or glasswork we install. We are not responsible for the structure it is fixed to, or for existing building conditions.
- Wall finishing, painting, patching, flooring and electrical work are not included unless the quotation states that they are.
- If our crew attends and cannot work because the site is not ready, a return-visit charge may apply.
10. Materials, finishes and natural variation
We work in steel, solid hardwood, stone, glass and wrought iron. Natural materials vary.
- Grain, colour, figure and tone in timber, marble and quartz vary from piece to piece and from any sample or photograph shown.
- Timber moves with temperature and humidity. Minor movement, seasonal gapping and settling are normal and are not defects.
- Powder-coat and stain colours may vary slightly between batches and may not match a printed or on-screen sample exactly.
- Site conditions, lighting and surrounding finishes change how a finish appears.
We will always tell you what to expect from a material before you commit to it. Ask for a physical sample if exact appearance matters to you.
11. Warranty
We warrant that your order is free from defects in materials and workmanship, and leaves us in good condition, up to the point of delivery. Goods are inspected before they leave our facility and again on delivery, as set out in section 8.
Once the goods have been delivered and accepted, they are in your care. Any damage caused on site by you, your contractors, trades or anyone else working on the building is at your or your contractor's expense, including repair, refinishing or replacement.
The warranty does not cover:
- Damage occurring on site after delivery, whoever causes it
- Normal wear, marking or patina from use
- Natural movement or variation in timber, stone or other natural materials, as described in section 10
- Damage from misuse, accident, impact, alteration or improper cleaning
- Damage from building movement, water ingress, or unsuitable humidity or temperature conditions
- Work carried out on our product by anyone other than us
- Goods that have not been paid for in full
To make a claim, contact us in writing with photographs and a description. We will inspect and, at our option, repair, replace or refund. That is your remedy under this warranty.
12. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.
Subject to that, our total liability arising from any order is limited to the price you paid for the goods and services concerned. We are not liable for indirect or consequential loss, including loss of profit, loss of use, delay to other trades, or cost of alternative accommodation.
13. Intellectual property
Drawings, renderings, engineering details and designs we prepare remain our intellectual property. They are supplied for the purpose of your project and may not be passed to another manufacturer, reproduced or used to produce the same design elsewhere without our written consent.
We may photograph completed work for our portfolio, website and marketing. If you would prefer we did not, tell us in writing and we will respect it.
14. Privacy
Personal information you give us is handled as set out in our privacy policy.
15. Governing law
These terms and any contract formed under them are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction, subject to any consumer protection rights you have in your own province or territory.
16. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one in effect on the date your order is accepted. The date at the top of this page shows when this version was published.
